An 18-year old girl is picked up by her married 45-year old driving instructor for her very first lesson. He takes her to an isolated road, pulls her out of the car, wrestles her out of one leg of her jeans and forcefully rapes her. Threatened with death if she tells anyone, he makes her drive the car home. Later that night she tells her parents, and they help and support her to press charges. The perpetrator gets arrested and is prosecuted. He is convicted of rape and sentenced to jail.

He appeals the sentence. The case makes it’s all the way to the Italian Supreme Court. Within a matter of days the case against the driving instructor is overturned, dismissed, and the perpetrator released. In a statement by the Chief Judge, he argued, “because the victim wore very, very tight jeans, she had to help him remove them, and by removing the jeans it was no longer rape but consensual sex.”

Enraged by the verdict, within a matter of hours the women in the Italian Parliament launched into immediate action and protested by wearing jeans to work. This call to action motivated and emboldened the California Senate and Assembly to do the same, which in turn spread to Patricia Giggans, Executive Director of Peace Over Violence, and Denim Day in L.A. was born.

What are your thoughts?

That the verdict is bs. She could have "gone along" with it, because her other option may have been be brutally beaten to death. Even if the victim stripped herself completely of clothing, there are a lot of reasons why the sex wasn't consensual.

I strongly believe that you have the right to be completely nude with your partner after serious foreplay and still not have to have sex with him/her.

Ugh, that gave me chills. The fact that rapists get away with things like that makes me sick to my stomach. I think all sexual offenders should be put to death. I don't believe in rehabilitation and I sure as hell don't believe in letting them off like that. How terrible.

Boils me every time I hear this. Even if she was dancing around naked it's still rape if she said no! How could anyone let that scum bag get off??? Geez. He was the adult in the situation and should have known better.

Yeh... I really hate that... Many women get put in situations where they are afraid to say no.

I've had what I call, "consentual, non-consentual sex." Where I didn't want to have sex, but I was so afraid of what would happen if I said no, that I went along with it. As a result, it's not "rape" because technically, I didn't say no.

It's really hard when you end up in a bad situation. You have to weight all your options in like a 1/2 second. And it's even harder if you've been drinking prior, since chances are, he's drunk too. Do you tell him no, and risk what might happen (especially if you dont know the guy), or just give him what he wants so you can get the situation over with as fast as possible.

They were young and stupid, and their boyfriends were older and threatened to breakup with them. Even though they consented, it still makes me sad.

Even if the courts didn't prosecute him, I hope that bastard got fired or found no work and his wife divorced him.
