This Petticoat MSF seems authentic enough, but it does violate eBay policy which states that the sale of used cosmetics is prohibited.

It was listed as used yesterday, but that's now been changed to "used, but not used":
Petticoat Mineralized Skinfinish MAC - eBay (item 140230353797 end time May-11-08 13:15:54 PDT)

It is also shown in the Vogue forums [ here ], along with swatches of the item. I own multiple MSFs and know it's virtually impossible to have two identical ones.

This is the exact photo used in the eBay listing.

And here it is, clearly poked.

Can the seller do this?

I think the seller wanted to let people know that it's been swatched but not 'tested or used' as in using the product on her face. Maybe eBay strict and does not allow swatched product. I'm not sure..

For US and I believe, Canada ebay, used is used. They can't sell a swatched product as new, because by ebay standards it's no longer an unused product. The auction is in violation of ebay's rules and will no doubt get yanked. Ebay is also much more responsive to someone selling a used cosmetic than a counterfeit one. Kind of sad in some ways.

I once watched and almost bid on a MAC shadow pallete where the seller clearly stated how much was left of each color and the pics showed the indentations.

eBay is a slacker when it comes to used/counterfeit cosmetics. They are extremely alert, however, when it comes to genuine MAC (and other branded) cosmetic sellers: Limiting the number of sales, cancel listings due to some invalid/unreasonable reasons, etc, yet those fakers are able to get away with tons of listed FAKES.

WTF?? How can an item be used, but not used? It's one or the other. I reported this item. Used cosmetics is prohibited on Ebay. Hopefully they will pull the listing.

Now it doesn't even say it's been used like the previous auctions, so the person buying this is being misled.

Since eBay UK allows people to sell used make-up, does that mean they are allowed to sell pigment samples? Because i remember it was banned a few years ago from the US & Canadian eBay!
