Need advice on a sale I purchased from

Okay so I purchased from a sale that a fairly well-known person held. My echeck for the sale cleared on July 7th, and I still haven't received anything. I have emailed the person numerous times and they have always been really friendly, and just explained that a lot of stuff has been going on in their life so they haven't sent out all of the packages because some were returned for an unknown reason. I feel bad that I keep bugging them especially because there is a lot of stuff going on, but at the same time I'm kind of... annoyed I guess. I'm considering asking if I could just get a refund but
1. There's no proof that I haven't received my package, and there's no proof that they haven't sent it so maybe it got lost...? I'm just worried that it might turn sour and it would be my word against their's.
2. I feel bad because they could really use the money.

I guess I'm just looking for some advice. I trust that they are being completely honest with me but it's still irritating.

If you paid with paypal you can open a dispute based on the fact that you have not received your item. Also when I sell I save all of the receipts from the post office so maybe she has proof of shipping from a saved receipt. Does she know if she has sent yours or not? Also you might want to join swap talk which can give you some great advice for what to do. Sorry about your situation. I know that it can be frustrating.
