Angi's right....that process is done in the resolution center here in the states. I'm also aware a bid is binding but if it turns out the item you're bidding on is counterfeit, where is it fair that you have to pay the cost of it? A seller has to not break the law and sell copied products and then think a person with perfect feedback will roll over and take it like a witch. 5 for $25.50? Whatever MAC store she shops at, I want to switch because she won this at the cost of less than 2 lustreglasses in my land. You're handling this in the right method and I'm sorry Ebay has greedy people sometimes...she files that strike, resolution claim her behind and save the e-mails you sent and received just in case.

A bid is binding when that's the item you actually are bidding on...not when it's a misrepresentation of an item. I'd pay for an item I knew was real but Ebay will lose me all together when they start thinking I'm paying a con artist to sell me copies. You get what you pay for and it's the sellers' place to make sure you've gotten what you expected to after paying.....not a gross misrepresentation that smells like Pine Sol in a tube mixed with stagnant water. Good luck and stand your ground.

I appreciate all your info and thoughts. Im usually happy with everything I buy on ebay but this just isnt right. I hope I win. I dont want a strike against me, but I know its fake and I dont believe she should just take my money. Ill keep fighting. Thanks for your support

I have noticed few of these on ebay UK,one seller was selling lot of 4 for like £18!!!Item number:280363720944,em_make_up,this seller reply to me was when i quieried the authenticity ..all my stuff is genuine i have invoices"

Maria,i would not pay ....yet because any decent,genuine seller would take 5 min of their time to answer query with regards to the products they just sold.I mean i do not expect sellers,to sit at their PC ,24/7 but you emailed her 3 times...Her not answering your questions would make me suspicious,but than that's me and being a Scorpio,im very suspicious by nature

Also, the lustreglass lids have more of a matte blue sheen to them, rather than being the shiny black of the lipglasses and the lids look incorrect to be consistent with a lustreglass.

Thanks Everyone!!! I spoke to another rep today who told me not to pay. If Trust & Seller finds the items to be Fake , they will remove them and I wont get any strikes or negative feedback against me.

Lets pray it goes my way!!!

For chrissakes, do not pay this woman. The items are most likely fake. If that is supposed to be a picture of the actual items, then they should ALL say lustreglass underneath, and why do most of the colors look damn near the same?

I would just not pay her, and move on. I realize that you do not want to jeopardize your good name, but it's just ebay. The most she can do is give you an unpaid item strike, whereas you'll be out $25 if you pay this woman and they turn out to be fake (which it seems like they are). An unpaid item strike is not the end of the world, and at least you won't have given your money to a counterfitter.

^^ i agree. plus if she gives you negative feedback at least you get to post a response on why you didnt pay for item. Feel free to SCREAM back at her that her stuff was fake and that was the reason why you didnt pay her $25 bucks ! Im sure future sellers will understand and never buy MAC on ebay again !

One strike doesn't close an Ebay account and you can blast that you weren't willing to pay for fakes. Those tubes look similiar and lack proper name of packaging just as the person said above. They close an Ebay account at 2 strikes but you're clean as a whistle usually, so no stress. I understand you value your name but you have to value your wallet as well...only thing good of this is you paying and yelling fake never to use the items...which would suck. I would say eff that bee and send no money. <----That was so gangster.

I agree. Don't pay her, and if ebay get in contact with you tell them all the reasons that you believe these items to be fake.

I also emailed her a couple of days ago asking her for the colour names on the lustreglass. All she replied was 'thanks for your interest'. Not 'I'm on holiday I don't know', she's trying to avoid the issue.

In my recent case with fake MAC,i did not get my refund!Paypal will demand that you have to prove that the item is counterfeit and in order to to this you have to obtain an official letter from someone who is knowledgeable in MAC products,someone like makeup artist or someone who works for MAC,you won't be able to just walk up to MAC counter and get confirmation of a fake as you have not bought from them.So save your dough and take the unpaid strike on your chin and wear it with pride.

Hi Everyone,
I read through this post with interest and have just a couple of comments - I hope they are useful:-
I sell on ebay myself and my personal opinion is that any honest and reliable seller will be only too happy to give you further information if you are doubtful about your purchase. Genuine Mac products carry the name and batch code in most cases - in fact although occasionally products are unlabeled I would be extremely reluctant to sell them!
Again genuine sellers will take time and effort to provide the information you request. To be honest if you are building a successful business on ebay selling Mac customer confidence and return custom is really important as Mac is still expensive to buy wholesale.
I have come across many fakes in the short time I have set up my business and they always remain unlisted and unsold as quite simply i would not want to sell fake products!
In addition if you are selling on ebay seriously and are away for a few days and on holiday you have a shop option to switc on to give your buyers inormation as to when you will return etc - i would suggest that if this is not done then the seller could well be using as an excuse.
To conclude the honest genuine sellers want to give their buyers as much information as possible - we need positive feedback and happy customers.
None of what you are explaining rings true - it is up to a seller to give their buyers confidence if they don't then to me that says something!!!

Awesome. I'd love to do that to sellers, but I don't want to get reported by any sellers, I like my account priviledges too much, so I guess I'll just keep reporting.

hi everyone. sorry i havent posted an update. i calmly emailed the seller asking if we could cancel the transaction and she said yes that was fine. but that she was on holiday for 2 more weeks. havent heard anything back from her and all her MAC listings have been removed.

***Update***

Lady said she'd agree to "Cancel" the transaction, she never dis the ebay steps, but gave me positive feedback??? And now has nothing for sale anymore!!
